SeaCube Containers LLC and its subsidiaries and affiliates (“SeaCube” or “we”), collect and process personal data for our activity and for the use of our website.

4. Purpose and legal basis for the collection and processing of personal data 

a. To manage our relationship with vendors, customers and other third parties
We process your personal data in order to manage your relationship with us, whether as a vendor, customer, employee or agent of a vendor or customer, or data subject in any way linked to SeaCube.

b. To comply with our accounting, legal, tax, and administrative obligations
We process your data to the extent necessary to comply with our accounting, legal, tax, and administrative obligations.

c. To manage customer/user service
We process your personal data to manage our customer care service.

d. To set up and manage your website registration
We process your data in order to create and manage your access credentials (username and password), your account, and to provide you with our online services.

e. To analyze your browsing activity
According the terms and conditions of our cookies policy and with the purpose of analyzing your browser activity, customizing your offers, and improving our online services and contents, we process the data obtained through your browsing activity in our online environments.

With the sole purpose of managing its contractual relationships, SeaCube can process contact details and third-parties’ representatives’ data with whom it maintains contractual relationships.

SeaCube regularly posts job offers where those interested may send us their resume and information. If you contact us or send your data, we will process it to assess your profile and consider you for any vacancy.

5. Sharing of your personal data

SeaCube may share your information with its affiliates and subsidiaries. We may also need to share your information with other parties, such as:

  • Public authorities with whom we are legally bound to share your data, like tax, customs, judicial or administrative authorities.
  • Third parties which require to process your data for the fulfillment of our contracts and relationships, like our customers, vendors or service providers.
  • External auditors.
  • Other third parties, in the case that you have provided your consent.

The recipients of your information shall process it as Data Processors and are bound by (i) the applicable laws and regulations and (ii) the instructions, organizational and technical measures imposed by the Data Controller, which guarantee an appropriate level of security.

We also inform you that some of our affiliates, subsidiaries or other third parties with whom we share your data are sometimes located in territories outside the European Union. In such case, we will transfer your data always under adequate and lawful guarantee mechanisms.

6. Period for which we will keep your personal data

We will only keep your personal data for as long as it is necessary for the purpose for which it was collected and to the extent permitted by the applicable laws. When we no longer need to process your information, we will keep it only for compliance with legal or regulatory obligations and/or for the time-barring term for civil, criminal commercial or administrative proceedings. After such term, the information will be deleted and removed from our systems.

We will ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are collected and processed. 

8. Your rights

You may exercise your rights on your personal data anytime, as described below:

  • Access: You can contact us to obtain information about which of your personal data we keep and how we process it. 
  • Rectification: You may correct or modify your data if they are inaccurate or incomplete.
  • Deletion (or the “right to be forgotten”): You may request that your data be erased if they are no longer necessary for the purpose for which they were collected, if the legal basis for the processing no longer applies, if you retire your consent or in any of the events determined by the applicable laws and regulations; except if we need to keep the data to comply with our legal obligations, or where the right of freedom of expression and information must prevail, or in such events as determined by the applicable laws and regulations.
  • Restriction of processing: You may request that we restrict the processing of your personal data (i) when you contest the accuracy of the data, while we verify them; (ii) when their processing is unlawful but you oppose to deletion and, instead, you request the restriction of use; (iii) when the controller no longer needs your data but you require them for the exercise or defense of legal claims; (iv) when you have exercised your right to objection, while we verify if our legitimate grounds for processing override your interests, rights and freedoms.
  • Portability: You can request your data in an adequate electronic format, and transmit them to another entity.
  • Objection: You may oppose the processing of your personal data under certain circumstances, unless there are compelling legitimate grounds for the processing that override your interests, rights and freedoms.

Where the collection and processing of your information is based on your consent, you may withdraw it at any time, without this affecting the lawfulness of any processing already carried out.

You have the right to file a complaint with the local data protection authority if you believe that we have not complied with our obligations under the applicable laws and regulations.

9. Data of a third party

In the event that, as a result of your relationship with us, you provide us with persona data of a third party, you will be solely responsible for (i) obtaining the subject’s prior written consent to transfer his/her personal data to us and (ii) for informing the subject of the purpose of the transfer, and of the terms of this Policy.

10. Children and minors

SeaCube does not collect or process personal information of subjects under the age of eighteen.

11. Links to Other Sites

SeaCube’s web site may contain links to other sites for which we are not responsible. We are not responsible for other sites’ content or privacy practices. Such web sites may collect personal information from you, may send their own cookies to you, and may collect information and use it in a way inconsistent with our Privacy Policy. In such instances, the collection and use of your personal information will be governed by the privacy policy applicable to that web site which should identify the entity that is collecting your personal information. Unless expressly stated, such references in no way indicate our endorsement, recommendation or preference of any such products, services or information contained on any other site.
